Acceptable Use Policy

Welcome to Presence ("Presence," "we," "our," or "us").

Presence is a private, curated membership community designed for adults 25 years of age and older seeking intentional relationships through authentic conversation and meaningful connection. This Acceptable Use Policy ("Policy") establishes the standards of conduct expected of all members and visitors using the Presence website, mobile application, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to comply with this Policy. Violation of this Policy may result in suspension or termination of your membership without prior notice.

1. Our Community Philosophy

Presence was created to foster respectful, genuine, and intentional relationships. Every member contributes to the quality and safety of the community. We expect all interactions to reflect honesty, courtesy, accountability, and respect.

Membership in Presence is a privilege, not a right. We reserve the right to deny, suspend, or revoke membership at our sole discretion to protect the integrity of the community.

2. Eligibility

To use Presence, you must:

  • Be at least 25 years of age.

  • Provide truthful and accurate information.

  • Maintain only one personal account unless expressly authorized by Presence.

  • Comply with all applicable laws and regulations.

  • Use the Platform solely for lawful, personal, and relationship-oriented purposes.

3. Prohibited Conduct

You agree not to engage in any activity that harms other members, the Platform, or the Presence community.

Prohibited conduct includes, but is not limited to:

A. Misrepresentation

You may not:

  • Create fake profiles.

  • Use another person's identity or photographs.

  • Misrepresent your age, relationship status, occupation, or other material information.

  • Impersonate any individual or organization.

B. Harassment and Abuse

You may not:

  • Harass, threaten, intimidate, or stalk another member.

  • Use abusive, hateful, discriminatory, or defamatory language.

  • Engage in bullying or repeated unwanted contact.

  • Encourage violence or illegal conduct.

Presence maintains zero tolerance for abusive behavior.

C. Sexual Misconduct

You may not:

  • Send unsolicited sexually explicit messages.

  • Share explicit images or videos without consent.

  • Pressure or coerce another member into sexual activity.

  • Solicit or exchange sexual services.

  • Engage in any unlawful sexual conduct.

D. Privacy Violations

You may not:

  • Record video calls without the express consent of all participants.

  • Screenshot, download, copy, or distribute another member's profile, photos, videos, or communications without authorization.

  • Publish another member's personal information.

  • Use information obtained through Presence to harass or exploit another individual.

Respecting member privacy is fundamental to the Presence experience.

E. Commercial Activity

Presence is not a marketplace.

Without our prior written consent, you may not:

  • Advertise products or services.

  • Promote businesses or investment opportunities.

  • Recruit members for unrelated organizations.

  • Conduct marketing campaigns.

  • Solicit donations or fundraising.

  • Use the Platform primarily for networking or commercial gain.

F. Fraud and Financial Misconduct

You may not:

  • Use stolen payment methods.

  • Engage in chargeback abuse.

  • Attempt to circumvent membership fees.

  • Provide false billing information.

  • Commit identity theft or financial fraud.

G. Platform Abuse

You may not:

  • Reverse engineer, decompile, or attempt to access the Platform's source code.

  • Use bots, scripts, automation, or scraping tools.

  • Attempt to bypass security features or membership approval processes.

  • Interfere with the operation or security of the Platform.

  • Introduce malware, viruses, or other harmful code.

  • Test or exploit vulnerabilities without written authorization.

H. Illegal Activity

You may not use Presence to facilitate or promote:

  • Criminal conduct.

  • Human trafficking.

  • Exploitation.

  • Fraud.

  • Money laundering.

  • Terrorist activity.

  • Illegal drug distribution.

  • Any activity prohibited by applicable law.

4. Video Features

Presence offers features that may include video introductions, video profiles, and live conversations.

By using these features, you agree to:

  • Participate respectfully.

  • Present yourself authentically.

  • Refrain from recording or redistributing content without consent.

  • Comply with all applicable laws regarding audio and video communications.

Presence may remove video content that violates this Policy.

5. Presence Chemistry Profile™

The Presence Chemistry Profile™ is intended to support compatibility and curated introductions.

You agree not to:

  • Deliberately provide false responses.

  • Attempt to manipulate compatibility outcomes.

  • Misuse or reproduce the assessment without authorization.

Presence reserves the right to modify or improve the assessment over time.

6. Intellectual Property

All content made available by Presence—including text, graphics, logos, branding, software, interfaces, designs, trademarks, videos, questionnaires, scoring methodologies, the Presence Chemistry Profile™, Presence Score™, Conversation Cards™, and other proprietary materials—is owned by Presence or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, create derivative works from, or commercially exploit any such content without prior written permission.

7. Reporting Violations

If you believe a member has violated this Policy, please report the matter to:

Presence will review reports in its discretion and may investigate potential violations. We do not guarantee any particular outcome or timeline for investigations.

8. Enforcement

Presence reserves the right to take any action it deems appropriate in response to violations of this Policy, including:

  • Issuing warnings.

  • Removing content.

  • Restricting access to certain features.

  • Suspending accounts.

  • Revoking memberships.

  • Refusing future membership applications.

  • Reporting unlawful conduct to appropriate authorities where required or permitted by law.

Presence is not obligated to provide advance notice before taking enforcement action.

9. PROHIBITED SEXUAL EXPLOITATION, ABUSE, TRAFFICKING & FRAUD

Presence maintains a zero-tolerance policy for sexual exploitation, abuse, trafficking, non-consensual content, sexually explicit content, and fraudulent activity.

Users may not use Presence to create, upload, transmit, display, solicit, promote, facilitate, arrange, encourage, or distribute:

• Child sexual exploitation or abuse of any kind, including Child Sexual Abuse Material (CSAM), grooming, sexualization of minors, or attempts to solicit or exploit minors.
• Sexual violence, threats of sexual violence, coercive sexual conduct, or content that depicts, promotes, encourages, or facilitates sexual violence.
• Non-consensual sexual or intimate content, including images, videos, recordings, or other material created or shared without the consent of the person depicted.
• Human trafficking, sex trafficking, sexual exploitation, prostitution, commercial sexual activity, or conduct intended to recruit, solicit, transport, harbor, exploit, or facilitate the exploitation of another person.
• Sexually explicit profile content, including pornography, explicit nudity, graphic sexual imagery, or profile content intended primarily for sexual gratification or solicitation.
• Scams, financial fraud, romance scams, impersonation for financial gain, deceptive solicitations, requests for money made under false pretenses, or other fraudulent activity intended to defraud or financially exploit another user.

Enforcement

Presence reserves the right to immediately remove prohibited content, suspend or permanently terminate accounts, preserve relevant records, restrict access to the platform, and report conduct to appropriate law-enforcement authorities or other legally authorized organizations when required or appropriate.

These prohibitions apply to all profiles, photographs, videos, video interactions, communications, member activities, and other use of the Presence platform.

Presence is exclusively for individuals age 25 and older. Minors are not permitted to create accounts, access member features, or participate in the Presence community.

10. No Expectation of Continued Access

Access to Presence is contingent upon ongoing compliance with this Policy, the Terms of Service, the Membership Agreement, and the Community Standards.

Violation of any of these documents may result in the loss of access to the Platform.

11. Changes to This Policy

We may update this Acceptable Use Policy from time to time. Material changes will become effective upon posting the revised Policy on the Platform. Your continued use of Presence after changes are posted constitutes acceptance of the revised Policy.
