Overview

Presence is a private membership community committed to protecting the privacy, safety, and trust of its members while complying with applicable laws. This Law Enforcement Request Policy explains how Presence responds to lawful requests from government agencies and law enforcement authorities.

Presence will only disclose member information when legally required or when permitted by applicable law to protect public safety.

Requests should include:

  • Agency name

  • Officer or representative name

  • Official government email address

  • Case or reference number

  • Legal authority supporting the request

  • Description of the information being requested

Presence may request additional verification before processing any request.

Legal Process Required

Presence generally requires valid legal process before disclosing non-public user information, including where applicable:

  • Court Orders

  • Search Warrants

  • Subpoenas

  • Other legally authorized requests

Requests that do not satisfy applicable legal requirements may be denied.

Emergency Requests

If a law enforcement agency believes there is an imminent risk of death or serious physical harm, Presence may disclose limited information without prior legal process when permitted by law.

Emergency requests should clearly explain:

  • The nature of the emergency

  • The immediate threat involved

  • Why expedited disclosure is necessary

Presence reviews emergency requests on a case-by-case basis.

Member Privacy

Presence is committed to protecting member privacy.

When legally permissible, Presence may:

  • Limit disclosures to only the information specifically requested.

  • Object to overly broad or invalid requests.

  • Require clarification before responding.

  • Protect confidential communications to the fullest extent allowed by law.

Data Preservation

Upon receipt of a valid preservation request, Presence may preserve relevant account information for a limited period while appropriate legal process is obtained, consistent with applicable law.

  • Membership status

  • Account creation date

  • Limited account activity records

Presence does not guarantee that requested information exists or has been retained.

International Requests

Requests originating outside the United States should comply with applicable international legal procedures and treaties before disclosure will be considered.
